It is always hard to argue for or against. When art is a reaction to the work of the artist himself as is done many times I have no problems with it but if it is just making the same than I consider it wrong. What is the intension? In the case of learning in a school to give the assignment to try to remake someone’s work than it is part of the learning and a hard task. Analyse an image and remake it takes a lot of knowledge. I always tell my students not to post them anywhere that the goal is just a learning one. To not het in trouble.

What is significant is that the law differs in various countries.
Claudette van der Rakt studied photographie with me and for her end work for the BA she made two images of a naked man and woman on their bed asleep. One, the girl was sold to a theatre. Years later the theatre moved to a bigger building and the idea was that someone who worked for the theatre would remake the image so that it could be printed larger. (without Claudettes knowledge). He visited Claudette in her studio during a atelier route and asked her how she made the image exactly. He then went home and copied the exact way to produce the image with another model. The image was printed and exhibited in the theatre. Claudette started a case and she won it. This because the goalof the photographer was to make a copy as exact as possible. In Belgium a photo was literaly copied by a famous painter. The photographer won the case as well. Because nothing new was added and it wasn't a reaction.

If it is ones intention to copy someones elses work I don't agree with it. I don't have a problem with a persiflage.

In the Netherlands we have a handboek for photographers about Copyrights written by a lawer; P. van Wijnen. It shows important and significant cases and explanes the outcome.
